In addition to Lisa's response, California also has certain presumptions with respect to whom the father of a child is. Given that you are married and presumably cohabitating with your wife, you may qualify for the rebuttable presumption that you are the father. Consequently, you will need to be a signatory to the agreement, acknowledging that you are not the father and agreeing to relinquish any interest in the child.
